EAST ST. LOUIS - Jurors in U.S. District Court cleared Georgia trailer maker Cottrell Inc. of any fault in a truck driver's injuries. Six jurors wrapped up a trial Sept. 14 with a verdict against Timothy Rosenburg, who blamed Cottrell for accidents that injured his back.

Two weeks earlier his attorney, Brian Wendler of Edwardsville, had declared he would prove $1,706,914.09 in economic loss.

Wendler also sought punitive damages and recovery for pain, suffering, loss of enjoyment of normal life and loss of consortium. The verdict represents a milestone for Cottrell, which constantly defends itself in Illinois courts hundreds of miles from home.

It represents a different kind of milestone for Wendler, his associate Thomas Maag, and Richard Armbruster of the Lakin Law Firm. For years they have carried on a string of suits against Cottrell in Madison County on behalf of Teamster truckers. The truckers claim they suffer injuries while loading autos on trailers due to faulty design and construction of the trailers.

I mean no disrespect to the plaintiff by this, as back injuries can be extremely debilitating-- BUT, some occupations are more hazardous than others. Mining or logging, for instance, expose workers to a lot more dangerous situations then those faced by a salesman or office worker. It is unfortunate when anyone gets hurt-- BUT, things happen. If Cottrell, Inc. was putting out dangerous equipment, one would expect hundreds upon hundreds of wrongful injury suits-- after all, Cottrell has more equipment on the road than anyone else. LOTS of people all over the country use Cottrell equipment, (not just the union drivers who availed themselves of this law firm's services ) so if the real problem was in the design of the trailers, it would be reasonable to expect LOTS of identical law suits from people all over the country, using all sorts of different lawyers.

As difficult as it must have been for Cottrell to defend itself against all these lawsuits far away from home, you could almost say they were lucky to have the trial in the mid-west, where (if these jurors are any indication) folks have still retained some of the common sense God gave them.
